New Jersey crash results in fatal personal injury to pedestrian

A recent car crash in New Jersey resulted in a pedestrian's death. One of the drivers involved in the two-car accident now faces criminal charges. Fatal personal injury accidents that lead to criminal charges also often lead to litigation in civil court.

The pedestrian accident took place in September. However, the driver deemed responsible for causing the victim's injuries never actually struck the victim herself. Authorities say the woman was talking on a cell phone when she crashed into another vehicle that was stopped well short of a marked crosswalk.

The impact of the collision caused the car that was hit to be propelled forward. It then struck the pedestrian. She was immediately transported to a nearby trauma center for care. Sadly, she died of her injuries several days later. So far, no charges have been filed against the driver of the car that directly struck the victim.

Police say the woman was using a cell phone when the fatal personal injury accident occurred. She was indicted for second-degree vehicular homicide. If convicted, she could spend up to 10 years behind bars. In such situations, an immediate family member of a deceased New Jersey accident victim may seek justice in court by filing a wrongful death case against the party deemed responsible for the collision. While there is no way to replace the loss of a human life, compensation in a successful case can bring tremendous financial relief to a grieving family by providing means to cover medical expenses and other financial losses associated with a loved one's death.
